Can You Drive After a Non-Alcoholic Beer in India?

Here is the short answer. Indian law does not look at what is printed on your can. It measures the alcohol in your blood. The law is quoted, with its source, on our numbers page.

What the law measures

Under Section 185 of the Motor Vehicles Act, 1988, the offence is driving with "alcohol exceeding 30 mg. per 100 ml. of blood detected in a test by a breath analyser, or in any other test including a laboratory test" (full text on Indian Kanoon). The same section sets the penalties. For a first offence, they are up to six months' imprisonment, a fine of ten thousand rupees, or both. For a second or later offence, they are up to two years' imprisonment, a fine of fifteen thousand rupees, or both. The section does not list any drinks. It defines the offence by the alcohol in your body, not by the drink in your hand.

What is in a non-alcoholic beer?

In India, the Food Safety and Standards Authority defines a "non-alcoholic counterpart of alcoholic beverage" as one with alcohol content at or below 0.5% ABV that meets every other standard of the beverage it is modelled on. The US and most of Europe use the same threshold. SOMA is brewed to stay under that line, and every batch is lab-tested to confirm it is below 0.5% ABV before it ships.

How much alcohol is in one can?

A 500ml can at the very top of that range holds at most 2.5ml of ethanol, which is about two grams. One 650ml bottle of a 5% strong beer holds roughly thirteen times as much, and a large peg of spirits also holds far more. You also do not drink those two grams all at once. A can takes fifteen or twenty minutes to drink, and a healthy adult liver clears that amount in roughly the same time. That is the physiological reason non-alcoholic beer does not cause intoxication.

Can a non-alcoholic beer affect a breathalyser reading?

Roadside breath analysers are built to sample air from deep in the lungs, which reflects the alcohol in your blood. For a short time, they are also sensitive to alcohol sitting in your mouth, which testing procedures call mouth alcohol. Right after you swallow anything that contains even a trace of alcohol, some residue can stay on your tongue and gums. That residue is not in your blood, and it disperses within a few minutes. This is why a proper breath-testing procedure includes a waiting period before the reading counts. In practice, never blow into a device with anything in your mouth. Rinse with water, wait a few minutes and breathe normally. The same advice applies after kombucha, after some mouthwashes and after a very ripe banana.

What we are not saying

We are a beer company, not lawyers, and none of this is legal advice. Here are three cautions, and we would rather overstate them than understate them.

First, if you have had an alcoholic drink tonight, none of the above applies to you. The trace of alcohol in a non-alcoholic beer does not matter next to an alcoholic drink, and the only number of alcoholic drinks that keeps you safe is zero.

Second, enforcement is carried out by people. A traffic officer at a 1am checkpoint is not there to check the label on your can. Be polite and be truly sober, and if a device gives an odd reading, ask for a repeat test a few minutes later.

Third, some people avoid even trace alcohol for medical, religious or personal reasons. If that is you, the decision belongs to you and your doctor, not to a beer company.

One label detail worth knowing

Indian rules stop a beverage above 0.5% ABV from describing itself as "non-intoxicating" or anything with a similar meaning. That works in your favour as a shopper. A drink that is truly under the threshold will declare its ABV, and a serious brand will lab-test every batch and say so clearly. If a can carries no ABV figure at all, that tells you something about how carefully it was made. SOMA is under 0.5% ABV, and every batch is tested to confirm it. The short version

Indian law measures blood alcohol against a limit of 30mg per 100ml. A 500ml can under 0.5% ABV carries at most about 2.5ml of ethanol, which you drink slowly, and it does not raise a person's blood alcohol toward that limit the way an alcoholic beer does. Mouth alcohol is a real effect on breath devices, but it lasts only a short time, and a few minutes and a sip of water solve it. If you have had an alcoholic drink, do not drive. No product can change that.
